Sonko successfully stops swearing in of Anne Kananu as Nairobi Governor

The Supreme Court, on Monday, stopped the swearing-in of Anne Kananu Mwenda as the Governor of Nairobi.

Justice Mohammed Ibrahim issued the temporary order for 14 days when the notice of Appeal filed by Former Governor Mike Sonko will be heard.

“I certify the said motion as urgent, having read the application and considered the grounds and justification of the urgency,” ruled the Judge.

The former governor filed by the Notice of Appeal at the Supreme Court seeking to set aside the whole of the Ruling and Order of the Court of Appeal which declined to stop the swearing-in Kananu as the Governor of Nairobi.

“If the intervention sought herein is not granted the jeopardy suffered by the Appellant (Sonko) is double – both the Court of Appeal in the 2 Appeals and this Honourable Supreme Court,” he said in court documents.

Sonko contends that the learned judges of the Court of Appeal in making their Ruling and Order disregarded the import of political rights.

He says the public is also interested in the outcome of the proceedings and hence the necessity of the preservation of the status quo.

“The learned judges of the Court of Appeal erred in law and fact by disregarding the fact that the Appellant’s appeal would be rendered nugatory and overtaken by events only to serve an academic purpose,” he argued.

Justice Ibrahim directed the application be placed before the Chief Justice to impanel a Bench of the court to hear the application inter partes.
